Crowds of Buddhist faithful visited temples throughout the kingdom and abroad on February 28 to worship and make merit on Makha Bucha Day (Buddhist All Saints Day). This important occasion for Buddhists marks the first sermon of the Lord Buddha to 1250 monks.

Locally, Wat Chaimongkol, Wat Sawang Fa, Wat Photisamphan, Wat Boonkanjanaram and Wat Nong Yai were filled to capacity when thousands of devout Buddhists turned out to conduct ceremonies that have been performed throughout Buddhist history, and make merit for themselves and their families.

Many also prayed for His Majesty the King’s health and quick recovery.

Anan, 59, who turned to religion and the temple to meditate for inner peace on this most holy day said, “Making merit is considered the most holy act of benevolence. On Makha Bucha Day, I hope and I pray for peace in our country and may all that is sacred grant His Majesty the King good health.”

The morning ceremonies were filled with people presenting alms to monks (“tak baht”) and listening to monks preach the Dharma, or teachings, of the Buddha.

Ceremonies were continued in the evening, with many people performing the “Wien Thien” whereby believers light candles and circle the temple’s prayer room three times, paying homage to the “Triple Gem” or the Buddha, Dharma (Buddhist teachings) and Sangha (monks).

This holy day commemorates the miraculous event when 1,250 disciples of the Buddha, Gautama Sakayamuni, traveled to Weluwan Mahawiharn Temple in the area of Rachakhryha, India to meet with the Buddha with no prearranged agreement.

Worshipping or ‘Bucha’ occurs on the 15th Day of the waning moon of the third lunar month, or ‘Makha’. This year the event fell on Sunday, February 28.

Somying, 52, said, “I am a vegetarian and uphold the precepts of Buddha Dharma in my daily life. I feel that because of the unstable social and economic situation in Thailand, the Thai people can take solace in Buddhism by making merit on Makha Bucha Day which we hope and pray will bring peace and prosperity to our people and our country.”

Banks, government offices and some businesses were closed on Monday, March 1 in observance of the holy day. Many bars were closed on Sunday, February 28 as a sign of respect for the nation’s religion.

The day gained official recognition in Thailand during the reign of King Rama IV and became a nationally observed day with all government institutions closing down and observing the rituals associated with Buddhist commandments.

Other countries where the Buddhist faith is predominant and where Makha Bucha Day is officially observed as a national day include Nepal, Myanmar, Cambodia, Laos, Sri Lanka and India. Other countries with populations observing the day but in limited numbers include China, Korea and Vietnam.

Disseminating the Buddha’s teachings and the journey to meet with the Buddha on the 15th night of the 3rd lunar month are part of the historical events that include the sermons and truths spoken by the Buddha.

Having good intentions, not harming others, avoiding evil actions and making the heart and mind pure in thought were among the truths spoken by the Buddha. Additionally, other truths spoken by the Buddha cautioned individual restraint in all that attracts one’s attention, to include desiring possessions belonging to others, and exploiting others for personal gain.

Before departing, the Buddha also referred to the people’s interest in making merit, gaining self-esteem and a comfortable reassurance that moral integrity exists. More importantly, having faith in the “Triple Gem” (Phraratanatrai) was illustrated by emphasizing the importance of avoiding drunken, irresponsible and immoral behavior, and maintaining focus on supporting loved ones while being content in one’s existence with friends and without selfish greed.

HM the King returns to hospital after short palace visit

His Majesty King Bhumibol Adulyadej returned to Siriraj Hospital early Sunday after a brief visit to his home at Chitralada Palace.

HM the King left Siriraj Hospital Saturday night for the first time after being admitted for treatment of a lung inflammation on September 19 last year.

Wearing a pink shirt, the monarch sat in a wheelchair with his pet dog at his side on Saturday night. His van arrived at the palace, passing rows of his subjects, sitting along the way, shouting encouragement by voicing “Long Live the King’.

The 82-year-old monarch has appeared in the public only twice during his hospital stay, on two special occasions - Chulalongkorn Day on October 23 and in November for the Loy Krathong festival.

The disappearance from the public eye of the world’s longest-reigning monarch has caused great concern among the Thai public and was linked to the largest decline in some two months in the Stock Exchange of Thailand in October after rumors circulated among investors of a deterioration in HM the King’s health. Thai court orders assets seized from ex-PM Thaksin

Bangkok (AP) - Thailand’s highest court ruled Friday that ousted leader Thaksin Shinawatra abused his power to enrich himself and his family while in office and ordered that $1.4 billion of his telecommunications fortune be seized.

The ruling likely disappoints, if not angers, Thaksin’s millions of partisans, boding ill for mending the rifts in Thai society after four years of political unrest centered around him.

However, some analysts suggested the court’s decision not to seize all 76 billion baht ($2.3 billion) at stake was a compromise that could foster reconciliation.

Thaksin was deposed by a September 2006 military coup after being accused of corruption and abuse of power. The action was meant to quell tensions sparked by months of anti-Thaksin protests, but instead polarized the country.

“The conflict won’t go away immediately. This verdict will simply allow the Thai people to cautiously carry on their lives the same way they have for the past two years,” said Prinya Thaewanarumitkul, a law professor at Bangkok’s Thammasat University. “I think we need to wait until the next general election to learn if the conflict will end.”

The country had increased security leading up to the verdict, but no major violent reaction was immediately reported. Thaksin, speaking by video link from exile, told his supporters to continue to fight for what he terms justice and democracy, but to do so nonviolently.

The passions Thaksin sparked led to the occupation of the seat of government for several months and seizure of the capital’s two airports for a week by his opponents in 2008, and rioting and disruption of a conference of Asian heads of government by his supporters last year.

His so-called Red Shirt supporters continue to rally on his behalf, and have promised a “million-man march” for later this month. They seek to force the government of current Prime Minister Abhisit Vejjajiva, a Thaksin opponent, to call new elections.

Thaksin and his followers insist he was ousted because Thailand’s traditional ruling class - the military, the bureaucracy and circles close the royal palace - felt threatened by his political popularity. He and his party won two sweeping election victories based on populist policies that benefited the country’s poor rural majority.

Speaking Friday night, Thaksin told his followers that unless they continued to struggle, “the country will remain in the hands of the elite forever.”

He also insisted, with a vow that he be struck dead if he were lying, that he never committed a corrupt act.

The Supreme Court ruled that in four of five cases presented to it, the 60-year-old billionaire politician had used his authority as the country’s leader in 2001-2006 to implement policies that benefited him, sometimes at the expense of the state.

As a small consolation, the court said that only 46 billion baht ($1.4 billion) of 76 billion baht ($2.3 billion) of his family’s assets that were frozen in Thai accounts after the coup should be seized. With other cases pending against him and his family, it is unclear when the remainder might be released. An unknown amount of Thaksin’s fortune is banked overseas.

The Supreme Court said seizing all the assets “would be unfair as some of it was made before Thaksin became prime minister.”

The most straightforward case of what is termed “policy corruption” involved a US$127 million low-interest government loan to Myanmar in 2004, which the court ruled Thaksin had promoted with the intention of securing its purchase of satellite services from Shin Satellite, then controlled by Thaksin’s family.

The other rulings charged that telecommunications policies had resulted in benefits for companies he controlled.

“Had they ordered to seize all assets, people would think Thaksin was not being treated fairly,” said law professor Prinya. “Now the friction has decreased, but we still need to watch Thaksin’s next move.”

Audio of the judges reading the 7 1/2 hour verdict was broadcast on several local television stations. Hundreds of people gathered at the headquarters of the opposition Puea Thai party - allied to Thaksin - booed as the final judgments were read. Some women began crying and one man jumped up on a chair and started screaming at a television screen broadcasting the proceedings.

“There is no justice in Thailand anymore,” said Krongtong Phuengsang, a 65-year-old housewife. “The Red Shirt people will continue fighting. But we will not create violence.”

Some chanted “Thaksin fight, fight” while others cursed the court.

Thaksin struck a familiar mix of self-pity and defiance in his video address from Dubai, his home in exile.

“Today’s lesson for businessmen, do not enter politics. If something happens, they will confiscate your money,” he said. “Let me be the last victim.” He was convicted in absentia in 2008 for a conflict of interest violation and sentenced to two years imprisonment.

Suriyasai Katasila, a leader of the People’s Alliance for Democracy movement that has spearheaded protests against Thaksin since 2006, expressed satisfaction with the court’s decisions.

“I don’t think the amount of assets to be seized is more significant than Thaksin’s wrongdoing being dissected and explained to the people,” he said. “This verdict will set up standards for future governments and politicians by letting them know the outcomes of abuse of power.”

Thanet Charoenmuang, a political science lecturer at Chiang Mai University, said he felt the verdict “eases worries among the public and could easily win the hearts of those in the middle.” He said it “could be viewed as an attempt at compromise by the judges who considered Thaksin’s actions unlawful.”

“The path to peace in Thai society depends on three things: the Red Shirts’ movement, economic and social circumstances and the government’s sincerity in solving the political conflict,” he said.

CARAT 2010 expected to begin mid-year

But the latter exercise’s move to February last year has also affected the schedule for Cooperation Afloat Readiness and Training.

Chaiyot Sunthonnak said that the CARAT exercise gives Southeast Asian countries - including Thailand, the Philippines, Singapore, Malaysia, Brunei and Indonesia - the chance to exchange information and expertise with their counterparts in the U.S. Navy and Marine Corps.

The exercise will focus on increasing experience levels for gunships, amphibious attack units and focus on marine security and target practice in Thai territorial waters.

Frigate Squadron 2 will lead the Thai side of the exercise, with the Royal Thai Fleet, Royal Thai Marine Corps Command, Air and Coastal Defense Command, Naval Armament Department and Naval Medical Department joining in. The U.S. will task Special Operational Naval Forces 712 and the Logistics Group with the responsibility of running their side of the operation.

During a week-long sensitivity training session at the Redemptorist Foundation for People with Disabilities for those working with the disabled, government and private-sector officials from Cambodia, Laos, Myanmar, Vietnam and host country Thailand discussed programs to increase knowledge and understanding for the rights of people with disabilities among organizations associated with their welfare.

Suporntham Mongkolsawat, director of the Redemptorist Vocational School for the Disabled, said the project - overseen in Thailand by the Ministry of Social Development and Human Security and National Office for Empowerment of Persons with Disabilities - is the Mekong River Basin countries’ effort at complying with the Convention on the Rights of Persons with Disabilities, which calls on governments to reduce barriers and discrimination against the disabled and give them more power and independence in their lives.

Training programs outlined at the Feb. 21-27 seminar call for creation of “power groups” to push for disabled rights, recognize obstacles to member countries reaching international training standards and creation of a training handbook. This also will serve as a foundation for better networking among the five countries, Suporntham said.

Services offered during morning hours include rabies vaccinations, sterilization and anti-flea and worm medications. Owners seeking sterilization are warned to not give their pet any food or water for six hours prior to the injection.

The program comes as the government tries to corral the growing number of stray dogs in the area, many of which start life as household pets but are abandoned by their owners.

Deputy Mayor Verawat Khakhay said the treatments help not only the animals, but people as well, which are kept safe from transmitted diseases.

Animal rescue officials pulled a 4-meter-long python out of a garbage-filled well by getting the snake to swim.

Sawang Boriboon Rescue Foundation officers were called to the Pacific Park Village on Soi A.R. in North Pattaya after city worker Nopadon Pankaew said he encountered a frazzled telephone line repairman who saw the 20 kg. snake fall into the disused well.

A professional snake catcher was called in to corral the slithery suspect, but couldn’t reach it due to a low water level and piles of garbage that kept the snake mostly below surface level. So the technician decided to fill up the well with water from a fire engine and the snake swam to the surface and was easily snared.

All ended well for the snake as it was released into the wild again later.

Acting on an informant’s tip, police arrested 18-year-old Cholthicha Thapmanee, who admitted she ran an escort service for about 10 school-age girls. Customers called her on her mobile phone and she arranged appointments for 1,500 baht, with her taking 500 baht of that as a commission.

Police made the arrest Feb. 21 after using an undercover officer to meet four teen girls at a Third Road restaurant. Once they paid Cholthicha the 6,000 baht in marked notes, they took her into custody. Two of the girls brought to the restaurant were under 18 and all four were from Roi-Et Province.

Cholthicha told police she arranged the appointments at the requests of the girls, who said they needed money to pay for their schooling.

In what has become an embarrassing regular event, police converged on the sand near Bali Hai Pier in the wee hours of Feb. 22 to find a crowd looking on and shooting pictures as two partially nude Russian lovers engaged in intimate acts better left in the bedroom.

The couple was fined on the spot and simply got dressed and strolled back on to Walking Street in search of a more-private venue.

Exorcism miraculously ‘cures’ poor Bang Saray girl supposedly possessed after visit to haunted drug den

The parents of an apparently mentally disturbed girl blamed ghosts and called in an exorcist to “cure” their daughter after her visit to a supposedly haunted Bang Saray beach house often used as a drug den.

Rather than consult doctors, impoverished Pia and Bunchouy Sornchanwong brought in a monk, an Indian-faith mystic and the media to witness the alleged mental illness and strange behavior of their 16-year-old daughter. They said the girl has been ill since she wandered off on Bang Saray Beach near their home and was found inside an abandoned building portrayed on film and television as a haunted house and a site that has seen a rape and frequent drug use by locals.

The girl’s parents, however, appealed to the media, claiming their daughter was possessed, but they had no money to take her to a doctor. They claimed she alternated between being nearly catatonic and raving, couldn’t sleep, wouldn’t eat and is quickly distracted. She often would speak in a man’s voice or not at all, and her parents expressed concern that she acts more like a boy than a girl and often tries to run away.

Neighbors believe the girl suffers from attention-deficit disorder or other mental illness and urged them to seek professional help. Instead, however, they took her to a local temple, where they had her baptized by a monk in hopes it would bring her peace. To an extent it did, as she slept more.

After their initial plea to the media brought attention, but little cash, to their case, they called in reporters again to witness an “exorcism” by a practitioner of Indian-style spiritual healing. Kritsada “Ajarn Robert” Saenkhot laid the girl out on a sofa in the couple’s dilapidated shack, used a twig to sprinkle allegedly “holy” water over the girl and, miraculously, she suddenly awoke from her catatonic state, professed to feel fine and asked to return to school.

Thais love a good ghost story, especially one with a happy ending. But, just to be sure, father Pia plans to keep the girl at home for a while to track her recovery.

Chonburi Immigration Police arrested a Thai man and are seeking another for running a brothel that employed underage Laotian girls.

Six immigration officers raided Chuanchom Karaoke in South Naklua Feb. 13 after two undercover officers purchased the sexual services of two 15-year-old girls from karaoke bar manager Kee Sukserm. The 27-year-old Loei native was arrested and police are looking for his employer, a 50-year-old identified only as “Somkhuan.”

During the raid, investigators found three underage Laotian girls, a ledger detailing the brothel’s operations and a book of rental coupons for the hotel 20 meters from the karaoke bar officers were told to meet the girls.

The girls told police they had entered Thailand on Laotian passports and were taken to an associate of Kee’s in Loei. They were then transported to Pattaya where their services were sold for 2,000 baht per customer, of which they received only 400 baht.

Kee was charged with human trafficking and his case was featured during last week’s presentation to Thailand’s deputy prime minister in Bangkok as proof of the Immigration Police’s efforts to stamp out human trafficking.

Raving Russian floored by Fairtex boxer after attacking hotel staff

A raving Russian took a knockout blow from a foreign boxer after he allegedly hit a hotel security guard with a bottle and locked an electrician in his room.

Police and Sawang Boriboon Foundation were called to the Fairtex Hotel in North Pattaya around 4:30 a.m. Feb. 24 on a report that a Russian man, who acted either drunk or high, had attacked hotel staff and was in a standoff with guests while threatening them with a sharp piece of metal.

Officers found Baksa Zoltan, 28, in a second floor corridor where another guest, who was also training as a boxer at the Fairtex sports complex, facing down each other as Thai staff and guests looked on.

The standoff continued for nearly an hour until the boxer managed to floor Zoltan with a punch to the face. Once the Russian was down, the Thais too scared to approach him before set upon him in a pack, until they could be pulled off by officers.

Injured security guard Phumirate Sangban, 28, said Zoltan had checked into the hotel on Feb. 18, but was rarely seen with other people and spent most of his time in his room. While patrolling the hotel that night, Phumirate said he heard noise coming from the second floor and, upon investigating, saw Zoltan had injured his hand somehow.

The guard said he and a hotel electrician went to tend to the Russian’s bleeding hand and were attacked, with Zoltan allegedly hitting Phumirate in the head with a bottle and locking the electrician in his room. It was then he called police.

Medics treated Phumirate for his injury at the scene and urged him to file charges against the rowdy Russian.

Navy Commander in Chief Adm. Kamthorn Pumhiran opened the exercise from the desk of the RTN Naraesuan at Laemtien Pier in Sattahip Feb. 18. During the exercises, naval forces honed their battle-readiness, including troop deployment, logistics, power usage and target practice.

Kamthorn said the war games emphasize making troops combat-ready and covers all the steps of battle preparedness, from pre-planning to field work to seminars on abstract concepts. A post-exercise presentation will be developed to illustrate training for those who did not participate.

The training ties in to the Eastern Seaboard’s emergency preparedness plans and aims to improve the navy’s ability to position ships, evacuate the public and counter terrorism.

A win for the rights of transgender and transsexual people the world over? Hmm. I’m 30. Not so young, but certainly so, so cynical.

I’m guessing that the airline name comes from the initials of the founder, Peter Chan, although in the West, PC has connotations centred on computers. And politics. The later, no doubt, underpins the temptation to rejoice.

No surprises, I’m a bleeding heart. I want everyone treated better. Well, maybe not Lexus drivers, but pretty much everyone else. Better rights for women, for ethnic minorities, for the transgendered, for the transsexual. I want surgery choices respected, even those which make us queasy.

On the surface, inviting third sex applicants to cross the aerobridge seems like the kind of progress the Left has been waiting for. Equal access to employment, to the economy, of course, are fundamental to inclusion.

I’m just not so sure PC Air are really the equality champions they’re purporting.

Richard Branson is high up on my list of most loathed creeps. His entire empire appears largely built on scarcely-clever innuendo and scantily clad women draping themselves over his “assets”. Nowhere is this more evident than in the branding of his airlines.

Mind you, Branson didn’t concoct the idea of sexualising women in subordinate roles. He didn’t dream up form-fitting uniforms, didn’t coin the term “trolley dolly”. His airline just happily promoted the unofficial G-string policy.

From Southwest Airlines in the 70s, Singapore Airlines’ Singapore Girl in the 80s and more recently the sleazy efforts of Virgin Atlantic, V Australia and Russia’s Avianova, airlines have long seduced us into parting with our cash through the lure of lipstick and heels. Even Lynx, the favoured deodorant of zit-ridden fourteen-year-old boys everywhere, made notoriously good use of such staples.

Whether we like it or loathe it, sexual innuendo has long been an undercurrent of the airline industry. So, when a Thai airline boasts third sex staff, I’m inclined to wonder whether the dreams Chan is promising to make “come true” are those of his new third sex staff, or – as I suspect – of his passengers.

People travel to Thailand for all kinds of reasons including elephants, tinnies of Singha, hair braiding and counterfeit consumer foods. More controversially, some people go purely for the kinky sex.

A handful of countries have become destinations for people – most often, but not exclusively men – to procure the kind of sex they can’t get at home. Or the kind that’s illegal at home. Or frowned upon at home. Or damn well expensive at home.

Sex with “ladyboys” is a popular menu item in Thailand.

PC Air hasn’t quietly offered work to third sex employees in a gentle, unassuming, championing-of-human-rights kind of way. Nope, they’ve issued a press release. Chan’s calling himself a “pioneer”. The airline is positioning itself as some sort a doyenne of decency. And is simultaneously making the new staff wear special gold-coloured “third sex” badges. (Whether these will take the form of patches, sewn to uniform sleeves, is yet to be determined).

In a competitive market, airlines need to achieve cut-through. Just as Virgin Blue plays up the fun, sexy, youth elements and Qantas tries desperately to clutch on to patriotism and safety, PC Air is playing up the kink.

I like equal opportunity. I might even love it. Less appealing is what smells a little like exploitation, a lot like dirty marketing and in time, a whole lot like impending sexual harassment litigation.

Kevin Pietersen scored a brilliant double hundred as England took advantage of the absence of India seamer Zaheer Khan to assume a dominant position after two days of the first Test at Lord's.

Despite struggling to find his characteristic fluency, and two reprieves from the third umpire, Pietersen ground his way to a century off 216 balls - but his second ton was a different story, taking just 110 balls as he became the fourth fastest England batsman to pass 6,000 Test runs.

The 31-year-old shared in century partnerships with Ian Bell (45) and Matt Prior (71) and added a quickfire 49 in four overs with Graeme Swann as England raised the tempo in the final hour of play before declaring on 474-8.

It left India openers Gautam Gambhir and Abhinav Mukund a tricky final half hour, but they survived six overs to reach 17-0.

The only bright spot on a difficult day for the tourists was the performance of seamer Praveen Kumar, who recorded figures of 5-106 from 40.3 overs. Australia and Malaysia 'to sign deal on asylum seekers'

A deal to send 800 asylum seekers in Australia to Malaysia in exchange for 4,000 refugees is to be signed on Monday, a Malaysian official has said.

The home ministry official said the one-off exchange of boat people would be formally agreed in Kuala Lumpur.

Many refugee claimants held at Australia's Christmas Island detention centre have expressed frustration at long delays and overcrowding.

Inmates have held a third night of violent protests there, police say.

A spokesman for Australian Immigration Minister Chris Bowen said of the deal: "It's close, we will be able to say more in coming days."

The UN has previously criticised Australia for holding all asylum seekers while their applications are assessed.

The migrants are held for months at the Christmas Island centre, about 1,500 miles (2,400km) from the Australian mainland, and in other facilities.Malaysia is home to tens of thousands of illegal migrants and is not a signatory to UN conventions on refugees.

Australia currently has more than 6,000 asylum seekers in detention, originating from countries including Iran, Iraq, Vietnam, Sri Lanka and Afghanistan.

Last year, more than 25,600 refugees registered with the UNHCR in Malaysia to seek asylum, the highest among all countries where the refugee agency has offices.

Meanwhile, immigration officials said there had been "another significant incident" at the Christmas Island centre overnight involving up to 100 detainees.

"The detainees used improvised weapons and lit a number of fires in a number of locations within the centre," a police spokeswoman told AFP.

Refugee advocate groups said some detainees lay in shallow graves to symbolise their desperation.

"Asylum seekers in the Green compound have dug shallow graves in the courtyard of their compound," said refugee advocate Ian Rintoul, who keeps in regular telephone contact with detainees at the centre.

"Some asylum seekers have already staged mock burials and buried themselves up to their necks in a symbolic protest that detention is killing their bodies and their minds," he said.

Norway: Blast near prime minister's office in Oslo

Norway 'al-Qaeda' bomb plot: Three arrested in Oslo

Three people have been arrested in Norway on suspicion of preparing terrorist attacks.

Unnamed Norwegian and US officials told the Associated Press that the men were members of al-Qaeda and had been under surveillance for a year.

They said it was not clear whether the men had selected a target, but they were attempting to make peroxide bombs.

The BBC's security correspondent says Norway may have been targeted because it has troops in Afghanistan.

"The Norwegian Police Security Service (PST) has today, July 8, 2010, arrested three people suspected of preparing acts of terror," the PST said in a statement on its website.

Prosecutors say the Norwegian case is linked to foiled bomb plots in New York and the English city of Manchester.
Twin plots

On Wednesday, US prosecutors charged five men in New York over a plot to bomb the underground system. The plot was foiled in September.

The New York plot also involved peroxide bombs, prosecutors said. One man, Najibullah Zazi, has already pleaded guilty.

"The charges reveal that the plot... was directed by senior al-Qaeda leadership in Pakistan," the US Department of Justice said in a statement.

One of those charged in New York is Abid Naseer, 24, born in Pakistan and arrested in the north-east of England on Wednesday. The US is now seeking his extradition.

Mr Naseer was remanded in custody by a court in the UK on Wednesday night.

Suspended former Fifa presidential candidate Mohamed bin Hammam begins his attempt to clear his name of bribery allegations on Friday.

Fifa's ethics committee has started a two-day hearing to rule on claims the Qatari tried to bribe Caribbean delegates to vote for him as president.

Bin Hammam pulled out of the race in the wake of the allegations and was provisionally suspended on 29 May.

He has promised to provide "convincing evidence" to prove his innocence.

"There has been a campaign waged within certain quarters," he wrote in a blog.

Phnom Penh - Police in Cambodia arrested a man claiming to be an adviser to US President Barack Obama and head of an international finance organization that stores its assets in caves and sunken ships.

Ray Dam and associate Soush Saroeun were charged with forgery Monday after being arrested at Dam's home in Phnom Penh. They were accused of forging documents alleging connections with HSBC Bank, the US government and the United Nations.

The pair had been operating a self-described international real-estate consultancy known as Asia Real Property out of modern offices in the Cambodian capital.

Asia Real Property's promotional materials identified the firm as a subsidiary of a group called the Office of International Treasury Control that claimed to be 'the largest single owner of gold and platinum bullion in the world,' holding cash and treasure in a variety of clandestine locations.

'Much of the treasure is buried in tunnels, bunkers and caves and in sunken ships,' the group said in an investment presentation. 'Further treasures are hidden all around the world.'

Dam is identified on the group's website as the 'sole arbiter ... of the Tripartite Gold Commission,' which was a post-World War II organization that searched for gold stolen by Nazi Germany and was dissolved in 1998. The website also said Dam was an adviser to Obama and his predecessor George W Bush.

Police said Dam and Saroeun had been advertising financial services to foreign joint venture partners in company documents claiming a connection to HSBC Bank. If convicted, they face a maximum of 16 years in prison.

According to an investigation report from police, Dam was born in Cambodia, fleeing the country for the US in the 1970s before returning in the early '90s. US embassy officials said they had been unable to confirm whether he holds US citizenship.

Officials from Cambodia's Ministry of Finance lodged a complaint against Dam and Saroeun after learning that the pair were operating without a real-estate licence. A government spokesman said Cambodian Prime Minister Hun Sen had ordered an investigation after learning that Dam had been posing as an adviser to the president of Cambodia's Senate

Tuol Kork district authorities have given 18 families living in Boeung Kak lake’s Village 23 one week to dismantle their houses, accept compensation and relocate to Dangkor district.

Affected residents say their homes, which lie in the path of a planned access road to the controversial Boeung Kak lake development, will be bulldozed if they fail to meet the deadline.

Resident Ou Norleak, 38, said on Thursday that in a Wednesday meeting between deputy district governor Pich Keo Mony and the families, authorities said they will take drastic measures against those who resist.

“We can’t accept this because we have lived here for years,” Ou Norleak said. “Please Samdech Hun Sen, help your children. We will not be able to build a new house with this compensation.”

Huy Sokhon, another resident from Village 23, described the authorities’ actions as “dictatorship”.

In October, district governor Seng Ratanak told the families to remove their homes and accept a land plot in Dangkor district and 1 million riels (US$250), to make way for the widening of the access road R8 by developer Shukaku Inc.

Ek Yoeun, an official at the Tuol Kork district office, said Thursday that he did not join the meeting, but claimed the authorities had increased the compensation payout to 5 million riels ($1,250), up from the previous offer of 1 million.

“I heard some people asked for $50,000. The government’s policy is only to give a land plot in Kork Ksach village [in Dangkor district] and a small amount of money,” he said.

Ever since urban centres were formed in Cambodia, usually around centres of trade and industrythere has been an understanding gap between people living in the rural areas and people who became accustomed to life in the city.

Ethnic groups tended to stay in the rural areas, and because they have been separated from places like Phnom Penh, they are seen, and often see themselves as foreigners in their own country when they come to the capital city.

In order to facilitate a greater sense of understanding and community between rural and urban populations, Khmer Community Development, officially established in 2005, invited 750 youth from 7 minority groups in Cambodia to join each other for a weekend of dialogue, activities and developing relationships.

Ngach Pheaktra, a tenth grader from Mondulkiri province, took part in the camping activity and said that, because this was his first trip to Phnom Penh, he sometimes felt like an outsider.

“I feel strange walking along the buildings and houses here. They are all made of brick, while our houses back in our villages are made of wood,” he said, adding that his home doesn’t have too many mosquitoes and he rarely goes on difficult journeys, but his homeland does have mountains, trees and wild animals.

Ngach Pheaktra says Phnom Penh seems much more dangerous, with all of the vehicles moving around the city. “I do not feel secure at all when I am in Phnom Penh. I heard of robbery and rape,” he said. “Compared to Phnom Penh, my village is much better off and safer,” he added.

For Kham Sopheap, a 17-year-old and twelfth grader from Rattanakiri province who is part of one of the ethic minorities in the area, told Lift that she can hardly breathe in Phnom Penh, unlike here village where there are plenty of trees and therefore lots of fresh ait. As a child, she faced a discrimination from students who asked her why she even came to school when she could not speak any Khmer. By the time she was eight, however, she was able to speak Khmer well enough to converse with her classmates.

“There are some things I like about Phnom Penh and other things I don’t like,” she said. “I like it for its amusement parks and the Royal Palace, but I certainly do not like when Phnom Penh is too crowded.”

Lat Bunart, an eleventh grader from Ratanakiri, said that she feels like Phnom Penh is a place only for wealthy people, whereas her village doesn’t require people to be rich. “People in my village are so friendly and welcome the poor and the rich, but people here seem so busy with their businesses and work,” she said. “In our village we spend the day farming and have much more free time to enjoy life.”

(New York) - The Cambodian government's use of its new penal code against a man who shared web articles with his co-workers is a huge step backward for free expression in Cambodia, Human Rights Watch said today. The man was quickly convicted on incitement charges and sentenced to prison.

Human Rights Watch called on the Cambodian government to amend the penal code, which went into effect on December 10, 2010, to remove provisions that limit the peaceful expression of political views so that the law fully complies with international standards.

"Charging someone with incitement for sharing web articles is a profound setback for free expression in Cambodia," said Phil Robertson, deputy Asia director at Human Rights Watch. "Cambodia's new penal code should have put an end to abusive practices, not encouraged new ones."

On December 18, Seng Kunnaka, a Cambodian employee with the United Nations World Food Program in Phnom Penh, was arrested on charges of incitement under article 495 of the new penal code after he shared an article with two co-workers. While the contents of the article are unclear, it was printed from KI-Media, a website that publishes news, commentaries, poetry, and cartoons that are sharply critical of the government, including a recent series of opinion pieces lambasting senior officials regarding a border dispute with Vietnam.

On December 19, the Phnom Penh Municipal Court hastily tried and convicted Kunnaka, sentencing him to six months in prison and fining him 1 million riels (US$250). December 19 was a Sunday, when the courts are normally closed.

During the last two years, more than 10 critics of the government, including journalists and opposition party activists, have been prosecuted for criminal defamation and disinformation based on complaints by government and military officials under the former penal code.

The new penal code places greater restrictions on free expression, Human Rights Watch said. Responding to media inquiries about the case, Cambodia's information minister, Khieu Kanharith, said: "Before, using the argument of ‘freedom of expression' and opposition party status, some people could insult anybody or any institution. This is not the case now."

"A dubious arrest so soon after the new penal code came into effect shows that the Cambodian government is ready to use its new legal powers to criminalize peaceful expression and political dissent," Robertson said. "And Cambodia's pliant courts seem all too willing to throw any perceived government critic in prison after a rushed trial."

Under the new penal code, incitement is vaguely defined in article 495 as directly provoking the commission of a crime or an act that creates "serious turmoil in society" through public speech, writings or drawings, or audio-visual telecommunication that are shared with, exposed to, or intended for the public. It does not require the alleged incitement to be effective for penalties to be imposed, which include prison terms of six months to five years and fines.

The new penal code also allows criminal prosecutions for defamation and contempt for peaceful expression of views "affecting the dignity" of individuals and public officials, as well as of government institutions. It makes it a crime to "disturb public order" by questioning court decisions.

"The new penal code makes it more risky for civil society activists to criticize corrupt officials, police, and military officers who commit abuses or question court decisions," Robertson said. "This is particularly troubling in Cambodia, where the judicial system is weak and far from independent, with court decisions often influenced by corruption or political pressure."

KI-Media is a controversial website that describes itself as "dedicated to publishing sensitive information about Cambodia." The website's editors, who have never publicly identified themselves, compile information from a variety of sources, including leaked and public government documents, Cambodian-language newspaper articles, and Chinese, Cambodian, and Western wire service reports. Duch appeal hearings set for March

The Khmer Rouge tribunal’s Supreme Court Chamber will hear the appeal of former Tuol Sleng prison chief Kaing Guek Eav in March of next year, the court said in a statement Thursday.

The notorious jailer, better known as Duch, was sentenced to 30 years in prison in July by the court’s Trial Chamber after being found guilty of crimes against humanity and grave breaches of the Geneva Conventions. The court said his appeal hearings will take place “during the last week of March 2011”, adding that the exact dates and times of the hearings will be announced “in due course”.

“We expect that [the hearings] will be public,” court spokesman Reach Sambath said. “I think the court will always be full of people.”

Duch’s lawyers filed an appeal against the judgment last month, charging that their client falls outside the court’s mandate to investigate “senior leaders” and those “most responsible” for crimes committed under the regime of Democratic Kampuchea.

The appeal followed the shocking turnabout last year during closing arguments when, after accepting limited responsibility and essentially pleading guilty through months of hearings, Duch asked to be acquitted and released.

The court’s prosecutors have also appealed against the July verdict, claiming that judges had given “insufficient weight to the gravity of Duch’s crimes and his role and his willing participation in those crimes”.

They have called on the Supreme Court Chamber to sentence the defendant to 45 years in prison, reduced from a life sentence due to Duch’s unlawful pre-trial detention.

“There comes a point where the crimes committed are sufficiently grave and the offender sufficiently notorious, or in such a position of authority, that the highest sentence must be imposed,” the prosecutors wrote in their appeal. “That point was reached and passed here.”

41 civil parties have also appealed, requesting either that the court declare their claims admissible or amend their reparations award.

Purveyors of classic Khmer rock'n'roll, The Cambodian Space Project plan to take on the world

It's been eight years since I last made a trip to Cambodia and had the chance to stock upon some Khmer sounds. Last week I was in Phnom Penh for a few days, and I must say, the capital is buzzing; it's a veritable hive of activity and commerce.

I went for a walk down Sisowat Quay on the banks of the Mekong at dusk one evening, always a good time to take photographs, and I thought for a moment that I had been transported back to Harajuku in Tokyo on a Sunday, when all the wannabe bands and poseurs play and strut to groups of dancing fans. Down on Sisowat the scene was bustling with groups of dancers, some doing aerobics to dance grooves, while other more exclusive groups focused on the latest K-Pop moves. People of all ages joined in the public groups or chatted while they watched the K-poppers.

In that area there are music stores but they don't sell Khmer music, so on Saturday morning I headed for the so-called Russian market, where among the tourist stalls and DVD shops, you can find vendors who have a good selection of different kinds of Khmer music. I stocked up on some Sin Sisamouth collections (the top musical icon of popular music), along with a compilation featuring his duets with top female singers from the '60s and '70s, Ros Sereysothea and Pan Ron. I found a tasty phleng kar (wedding song) collection, as well as songs by Meng Pichanda, who sings a local moody style, not unlike Thai luk thung music, called ramkbach, and some interesting Khmer rap.

Later I found myself in the back of a cyclo with one of Pan Ron's biggest fans, Srey Thy, singer with the new band The Cambodian Space Project and the band's founder and leader, Australian guitarist Julien Poulson. Srey, upon finding out that my son's relatives are from Buri Ram in Thailand's lower Northeast, launched into several stirring renditions of kantrum hits, which Cambodians call "Khmer Surin" music.

We were on our way to a birthday party for the band's Breton accordionist, during which I met the revolving personnel of this unusual music collective. The band plays covers of Khmer rock'n'roll from the late '60s to early '70, when Phnom Penh was a regional entertainment centre, but with a multinational twist. Many of the great Khmer musicians of the period perished during the genocidal Khmer Rouge regime but interest was revived with the Cambodian Rocks compilations of the '90s, and then by the US-based Khmer/US band, Dengue Fever. Unlike Dengue, though, The Cambodian Space Project is actually based in Phnom Penh.

Julien said that he originally went to Cambodia to make some music documentaries but was so taken with the singing ability of Srey after he saw her sing in a karaoke bar, that he decided to set up a band. Cambodian, French-Cambodian and French members make up the rest of the band. Interest was generated immediately, not only among the expat population but also among local Cambodian music fans. In the just a year, the band has played over 200 gigs in Cambodia, as well gigs in France and Hong Kong. In the new year, the band will jet off for its first major tour that will encompass Australia, Europe and the US. Total world domination can't be far way.

The band's first recording has just been released, a 7" vinyl maxi-single that features, on the A-side, a killer version of Pan Ron's hit, I'm Unsatisfied. The B-side features a catchy song written by Srey called If You Go, I Come Too. Julien says that he noticed that Srey is a natural songwriter, so the band usually plays a mix of covers and self-penned songs. He says that the single is the first vinyl to be released in Cambodia since the early '70s.

Here's how he describes the global process: "The single was recorded in Cambodian at Cambodian Living Arts - a small studio which boasts a collection of mics donated by Peter Gabriel. It was mixed by Lindsay Gravina of Birdland Studios in Australia. The mixes were sent to London, then the masters sent via Rough Trade to the Czech Republic. We picked up our 'band copies' from a little record store in Bretagne, France called Rockin' Bones. A round-about kinda production but very rewarding to launch this vinyl in Cambodia... not too many turntables here but the vinyl's thick enough to mash chilli and chop vegetables in the village kitchen."

I've just heard an advance copy of the band's debut album, the title of which, in translation from the original Khmer goes something like The Moon's Apsara Rides The Cosmic Golden Swan-Goose. Groovy.

The album's standouts are a distinctive cover of Pan Ron's I'm Sixteen, which features some great blues harp and the two Srey penned songs, Kangaroo Boy (great for pogo-ing to and I predict will go down a storm in Australia) and Have Visa, No Rice. It's a fun album that is likely to raise the band's international profile.

The Cambodian Space Project is not the first band to rediscover and play '60s/'70s Khmer rock'n'roll but it is the first one based in Cambodia. If you liked all those great Cambodian Rock compilations and Dengue Fever, you'll certainly enjoy The Cambodian Space Project, several members of whom are stretching their wings to fly into Bangkok to play on Christmas Day.

A meeting with Vietnamese businesses took place in Cambodia on December 23.

Addressing the event, Ngo Anh Dung, Vietnamese Ambassador to Cambodia, reviewed the achievements and advantages in multifaceted cooperation between the two countries in 2010.

Two-way trade turnover in the first 11 months of 2010 reached over US$1.5 billion. Vietnam’s exports turnover to Cambodia gained US$1.3 billion, up 36 percent compared to the same period last year.

Currently, Vietnamese investments in Cambodia are worth nearly US$570 million, mainly in such fields as rubber planting, industrial crops, aviation, banking, services and tourism.

At the meeting, Vietnamese businesses expressed their hope that in 2011, the two governments will continue to simplify the trade and investment procedures to increase the value of trade exchange to reach US$2 billion.

The National Assembly is now urging for its Thai counterpart to approved a series of documents necessary for both sides to move ahead on border demarcation.

National Assembly Nguon Nhel told a Thai parliamentary delegation here on Thursday that the approval of a series of border meeting minutes was crucial for stability between the two countries.

“Through the visit of Thailand’s National Assembly delegation, we would like to urge and to demand the National Assembly of Thailand to approve the minutes of three joint border commission meetings to eliminate the conflict between our two countries and two peoples, so that we can build up a peaceful and friendly border demarcation,” Ngun Nhel said.

Thai parliament has not ruled on the meeting in part due to extreme political instability there. But officials in Phnom Penh have continued to push the Thais to do so.

Earlier this week, the same message was delivered to a delegation led by Thai Foreign Minister Kasit Pirumya and Thai army chief Paryuth Chan-ocha.

Ngun Nhel’s appeal went straight to parliament, with the delegation led by Gittipot Viriyaroj, the head of the foreign affairs committee and chairman of the Thai National Assembly’s Thailand-Cambodia Friendship Group.

Gittipot told reporters on Thursday he would push for approval of the meetings.

“I will try to promote a full border resolution between the two countries,” he said. “Our only purpose is to bring development and progress to our respective countries.”

The Supreme Court Chamber of the Khmer Rouge tribunal is scheduled to rule on all appeals in the case against torture chief Duch in March 2011, the court announced Thursday.

The chamber must decide on an appeal by prosecutors to lengthen his sentence; an appeal by defense to release him; and an appeal by civil complainants for some kind of public reparation.

Duch was sentenced to a commuted 19 years earlier this year, but prosecutors say this was too lenient for a man accused of overseeing the torture and execution of more than 12,000 people at Tuol Sleng prison. They want a sentence of 45 years.

However, defense lawyers claim Duch was following orders of the regime and shold be released.

Tribunal spokesman Reach Sambath said the chamber had determined a detailed schedule and would begin informing interested parties and the public.

Latt Ky, a tribunal monitor for the rights group Adhoc, said the final decision must be well disseminated.

“The public needs to know the final decision on the punishment of Duch,” he said.

Survivors of the prison and those who lost family there say they want him sentenced for life, said Chum Mey, who lived through his incarceration at Tuol Sleng and has formed a support association for other victims.

"All Khmer overseas have come together as one voice to support Khmer Surin in teaching Khmer language and safeguarding Khmer culture.”

A group of US Cambodians has begun looking for ways to encourage an increase in interest of the Khmer language in the Thai province of Surin.

That province was once part of a wider Khmer empire that encompassed parts of modern-day Thailand and Vietnam.

On Saturday, the Supporting Khmer Surin Committee held its first meeting, after a visit by some of its member to the province earlier this year. Members discussed the need to promote Khmer language in the area and the challenges faced by the so-called Khmer Surin people.

“There are many Cambodians doing business across the borders, so it will be easy for them to communicate,” said Srey Ayuthyia, the committee’s vice president, from Los Angeles.

Srey Ayuthyia said he had met with a Buddhist monk who taught the Khmer language and a number of Khmer Surin who expressed their need for more support.

While some Khmer Surin can speak Khmer, few can write it, but the there is a program that started four years ago that Srey Ayuthyia said he strongly supported.

The Supporting Khmer Surin Committee was only recently created, but its founders say they have already raised some funds to help their cause.

“We are not alone,” said Eang Bunthan, president of committee. “We are united around the world. All Khmer overseas have come together as one voice to support Khmer Surin in teaching Khmer language and safeguarding Khmer culture.”

BUENOS AIRES—Former Argentine dictator Jorge Rafael Videla, on trial for the first time since the country's Supreme Court rescinded his amnesty, was sentenced to life in prison by a federal court for the murder of 31 political prisoners in 1976.

Mr. Videla ruled Argentina from 1976 to 1981 and presided over the so-called Dirty War in which at least 10,000 people suspected of working against the regime, and perhaps as many as 30,000, were "disappeared" and killed, according to historians and human-rights groups.

After the country returned to democracy, Mr. Videla was sentenced in a landmark 1985 trial to life in prison for abuses committed during his rule. He served five years before he and other figures from the dictatorship were pardoned by President Carlos Menem, who said he was trying to close the book on a divisive era in Argentine history. The Supreme Court struck down the pardons in 2007, paving the way for new cases to be brought against officials from the dictatorship.

Wednesday's sentence was the culmination of a six-month trial in the city of Cordoba revolving around the case of 31 prisoners suspected of opposing the regime, who were rousted from their cells and executed following the coup that brought Mr. Videla to power. A three-judge panel issued the sentence, which it specified should be served in a common prison facility, as opposed to in a military jail or under house arrest.

Mr. Videla, 85 years old, sometimes appeared to doze off during the trial. He was defiant when he did speak.

"I don't speak of 'Dirty War,' I prefer to speak of 'just war,' " he said on Tuesday, asserting that his government had implemented a legitimate defense strategy against leftist guerrilla groups.

He took thinly veiled swipes at the government of President Cristina Kirchner, who has acted aggressively to bring former officials of the dictatorship to justice. "The enemies of yesterday achieved their goal and govern the country and they try to set themselves up as champions of human rights," Mr. Videla said.

Convicted along with Mr. Videla were 29 other security officials from the dictatorship, including former Gen. Luciano Benjamin Menendez, who headed anti-guerrilla operations in a large section of the country.

Obama signs bill to end Don’t Ask, Don’t Tell

President Obama has signed a bill to end the ban on openly gay troops in the US military.

Two years after he promised to end the controversial policy in his election campaign, the president signed the bill during a ceremony at the Interior Department.

Today, he said that the change would “strengthen our national security and uphold the ideals that our fighting men and women risk their lives to defend”.

Referring to the sacrifices made by servicemembers, he said: “None of them should have to sacrifice their integrity as well.”

An estimated 14,000 troops have been dismissed under the 1993 ban.

Last weekend, the Senate voted to repeal the bill.

However, it may take months before gay soldiers are permitted to serve openly and those fired can re-apply to join the military.

Military officials must consider and rewrite policies related to the issue over the next few weeks.

Then, President Obama, Defence Secretary Robert Gates and Joint Chiefs Chairman Adm. Mike Mullen must certify that the ban can be lifted without damaging the military.

Following this certification, 60 days must pass before repeal officially takes place.

Parents of gay suicide student will sue university

The parents of a New Jersey student who jumped to his death after his roommate allegedly broadcast his gay sex session are to sue his university.

Tyler Clementi, an 18-year-old student at Rutgers University, killed himself by jumping from the George Washington Bridge in September.

His roommate Dharun Ravi of Plainsboro, New Jersey, and Molly W Wei of Princeton, both 18, deny secretly recording him having sex with a man and broadcasting it online.

They have both been charged with invasion of privacy and have left campus.

Associated Press reports that Mr Clementi’s parents filed notice to sue last week and their attorney Stephen DeFeo said they will argue that Rutgers failed to implement or enforce policies that would have prevented or deterred the alleged invasion of privacy.

A Rutgers spokesman said that while the university was sympathetic to the Clementi family, it was not responsible for the student’s death.

Mystery remains over spy’s death

Police are still mystified over the death of British spy Gareth Williams, whose body was found padlocked inside a sports bag in August.

Mr Williams, 31, was a GCHQ code-breaker who was on secondment to MI6 at the time of his death.

His naked body was found locked inside a holdall at his Pimlico flat with the keys inside the bag. He is thought to have been dead for a week.

According to Press Association, police revealed today that he had visited bondage websites and had a £15,000 collection of women’s designer clothing.

They also said that a witness saw him at a gay bar in Vauxhall several months before he died and that he had visited a drag show a few days before his death. He also had tickets for two more drag shows.

Mr Williams is rumoured to have been gay, but police say they have not been able to speak to any of his sexual partners. He is said to have been intensely private.

Today, Detective Chief Inspector Jackie Sebire, who is leading the inquiry, said she believes Mr Williams was locked in the bag by another person and that police would continue to study his private life for clues.

Speaking at New Scotland Yard today, she said: “We remain completely open-minded about how he died.

“We are appealing today to someone who is out there to come forward and tell us more.”

No traces of drugs or alcohol were found in Mr Williams’ body. Experts found that he would have died after 30 minutes inside the bag from suffocation.

Police are seeking a man and a woman who visited his flat several weeks before his body was found and say that forensic evidence shows that other people were in the property.

His death is still being treated as suspicious and unexplained and an inquest will be held in February.

Federal inquiry into US gay teenager’s suicide

Federal education officials are investigating the suicide of a 13-year-old California boy who killed himself after suffering homophobic bullying.

Seth Walsh died nine days after hanging himself in his garden on September 28th. His family said he had endured years of harassment and abuse at school for being gay.

Last week, his mother Wendy accused the Tehachapi school district of ignoring her pleas to tackle the bullying.

She said his grades had fallen and that some teachers had even joined in the harassment.

Yesterday, a spokesman for Education Secretary Arne Duncan confirmed that federal education officials were investigating how the school district dealt with the issue.

Mrs Walsh said she contacted Department of Education investigators while her son lay in hospital in a coma before he died.

She said they spent two days in Tehachapi last week, interviewing teachers, administrators and students.

In October, the Education Department’s civil rights division told school districts that they must take steps to stamp out anti-gay bullying.

According to Associated Press, the department has the power to investigate school districts where bullying is said to be so severe, it has resulted in a “hostile environment” for students who are, or are thought to be, LGBT.

Mrs Walsh is being supported by the American Civil Liberties Union, which last week sent a letter to the school district on her behalf asking it to prevent another tragedy.

The ACLU says that at least 11 US LGBT teenagers have killed themselves after suffering bullying in the last few months.

UN votes to reinstate resolution condemning execution of gays

The United Nations General Assembly has voted to restore a reference to sexual orientation in a resolution opposing the unjustified killings of minority groups.

Last month, a UN panel deleted a reference to gays and lesbians in resolution introduced by Morocco and Mali. The vast majority of countries in support were African or Arabic.

Many of the supporting countries criminalise homosexuality and five treat it as a capital offence.

But today, the UN General Assembly voted 93 in favour of the United States’ proposal to restore the reference to sexual orientation, 55 countries voted against and 27 abstained. The assembly then approved the amended resolution with 122 in favour, none against and 59 abstentions.

The amendment passed last month called for the words “sexual orientation” to be replaced with “discriminatory reasons on any basis”. The resolution made explicit reference to a large number of groups, including human rights defenders, religious and ethnic minorities and street children.

It narrowly passed 79-70 and was then approved by the UN General Assembly committee with 165 in favour and ten abstentions. The motion condemns extra-judicial, summary and arbitrary executions and other killings, is voted on by the UN General Assembly every two years. For the past ten years, it contained references to sexual orientation.

Malaysian gay man gets death threats after support video

A Malaysian Muslim man who spoke out about being gay has received death threats and says he fears for his life.

Azwan Ismail, a 32-year-old engineer, made a YouTube video called ‘I’m gay, I’m ok’, in an effort to encourage other gay Malaysians to feel comfortable with their sexual orientation.

His video clip was part of a series posted by Malaysian activists and was inspired by the US It Gets Better project, in which LGBT people speak frankly about their own experiences growing up.

Mr Ismail told Associated Press that he was scared he was about to be killed and that his life had been threatened.

He was the only Muslim to take part in the project. Homosexuality is illegal in Malaysia but offences are not usually harshly punished.

He said: “My intention was not to insult Islam. I just wanted to represent gay Malays in this project. I hope these videos will help to create a more open society and more discussion.”

In the video, which has been viewed more than 140,000 times on YouTube in just six days, Mr Ismail talked about his faith and his sexuality.

One prominent Islamic cleric criticised him for “derid[ing] his own dignity”, while Malaysia’s Cabinet minister for Islamic affairs, Jamil Khir Baharom, said action may be taken to prevent more people viewing the video.

Mr Ismail said he was now taking safety precautions in response to the threats.

Five years of civil partnerships

Today is the fifth anniversary of civil partnerships in England and Wales.

The ceremonies, which give gay couples almost all of the rights of marriage, came into effect at 8am on December 21st 2005. Three gay couples in Brighton were the first to take advantage of the new legislation.

The very first civil partnership to take place was on December 5th 2005, between a gay couple where one partner was terminally ill.

An error meant that Scotland’s first civil partnerships were held on December 20th 2005.

Since 2005, an estimated 40,000 gay couples have entered into civil partnerships. London and Brighton remain the most popular areas for the ceremonies.

Last year, the average age for gay people to have a civil partnership was 41.2 for men and 38.9 for women. For straight couples, the average age at first marriage was 32.1 years for men and 29.9 years for women.

Currently, only gay couples may have a civil partnership. They cannot marry.

However, marriage equality campaigners hope to change this and will soon launch a legal bid to open up both institutions to everyone.

The coalition government has promised to work towards giving gay couples the right to religious civil partnerships but has stopped short of supporting gay marriage.

In a message released today, equality minister Lynne Featherstone said: “As well as benefiting the couples who have registered their unions, the introduction of civil partnerships has helped make a real, positive change in the way society thinks about lesbian, gay and bisexual people.

“As a government we’re committed to building on this progress, which is why we’re currently looking at what the next steps for civil partnerships could be.”

London men cleared of stab attack on ‘gay victim’

Two men and two teenage boys have been cleared of stabbing a man they allegedly thought was gay.

The group was accused of attacking Ricky Brown, of Homerton, east London, because they believed he had made advances to young boys after offering them drink or drugs.

Mr Brown, who survived being stabbed 12 times, said he had also been robbed.

After the attack in August last year, police arrested Bradley Goddard, 21, of Keston Road, Tottenham, Emmanuel Nwachukwu, of Station Road, New Barnet, 31, and a 16-year-old and a 17-year-old who cannot be named due to their ages.

The teenagers were arrested close to the scene but denied any involvement in the incident.

Mr Goddard and Mr Nwachukwu said to have been travelling in a car caught on CCTV in the area but Mr Nwachukwu said he had been in the area to buy cannabis with a friend.

All four were acquitted of aggravated burglary and two counts of burglary yesterday at the Old Bailey, the Muswell Hill Journal reports.

Preacher wins £7,000 after being wrongly arrested for homophobia

A Christian street preacher detained by police for being homophobic has won £7,000 in damages for wrongful arrest.

Dale McAlpine, 42, was arrested in Cumbria in April last year after he told a community support officer that homosexuality was a “sin”.

He was then arrested on suspicion of a public order offence by West Midlands Police.

Mr McAlpine, who regularly delivers sermons from a stepladder in Workington, was charged with using threatening words or behaviour to cause harassment, alarm or distress.

The charge was later dropped.

However, he sought the help of the Christian Institute and sued the force for wrongful arrest, unlawful imprisonment and breach of his human rights.

West Midlands Police have agreed to pay him a £7,000 settlement, plus court costs. He will also receive an apology from a senior officer.

Last week, a Christian street preacher who raged against the “effeminate” and said gays would go to hell won £4,000 in damages for being arrested.

Anthony Rollins, of Birmingham, was arrested in July 2008 when a passerby took offence to his remarks about homosexuality and called 999.

The bill will be passed this week to President Barack Obama who has already confirmed that he will sign it into law, saying: “It is time to close this chapter in our history. It is time to recognise that sacrifice, valour and integrity are no more defined by sexual orientation than they are by race or gender, religion or creed.

“It is time to allow gay and lesbian Americans to serve their country openly.”

The Senate passed the motion on Saturday 65-31 in favour of removing the restrictions on gays serving in the military. Numerous celebrities have responded positively to the vote.

Lady Gaga, who has been a vocal opponent of the ban, posted her reaction on Twitter, writing: “Can’t hold back the tears + pride. We did it!! Our voice was heard + today the Senate REPEALED DADT. A triumph for equality after 17 YEARS.”

Ellen DeGeneres also added her thoughts on the social networking site, saying: “Thank you Senators for pushing us one step closer towards full equality.”

Musician Katy Perry agreed with P!nk, stating: “SUPPORTING ALL OUR TROOPS! RT @Pink: Congrats 2 US!!! REPEAL of DADT & 17 years of allowing Human Rights Violations. There’s hope after all.”

Australian Catholics told to lobby MPs against gay marriage

The Catholic Church in Australia has advised its followers to call for politicians to resist gay marriage proposals based on the “natural order”.

MPs in Canberra are expected to receive calls from constituents who have been counselled by the Church to stress the importance of biological relationships, rather than protecting marriage as a religious institution.

The Sydney Archdiocese, the Catholic Women’s League and the Knights of the Southern Cross issued an open letter urging Catholics to take action.

The letter states: “Marriage between a man and a woman is not a religious construct but a natural institution found across all cultures and religions. Marriage is a unique kind of sexually complementary union with a natural orientation to life.”

The church has also written that heterosexual couples who are married but infertile have a greater right marriage than homosexuals because “their lovemaking is designed to give life”.

“Allowing two men or two women to marry would involve a fundamental change in our understanding of marriage, from a life-giving and sexually complementary union to a personal, romantic relationship with no true communion or connection to procreation.”

Currently, Australia’s Labor Party has an official policy against gay marriage.

The policy has been questioned recently, and a motion tabled by the Australian Greens party called on representatives to consult their constituents on the issue.

The motion was passed by 73 votes to 72.

Marriage Equality Spokesman Rodney Croome said the church should “should respect our right to marry under civil law – this kind of mutual tolerance is the hallmark of a modern, civilised democracy”.

“Our advice to the people we are encouraging to visit MPs is to highlight the fact that under Australian marriage law people of any faith or no faith can marry, as can people who cannot or do not wish to have children.”

Labour council candidate harassed rival with anti-gay abuse

A Labour council candidate has admitting bombarding his openly gay rival with homophobic abuse.

David Bradley, 29, of Bristol, sent 33 text messages to Ed Bramall, 33, calling him “creepy” and “vile”.

The messages also called gay people “bum rapists” and “gay lords”, the Bristol Evening Post reports.

Bradley, a failed Labour candidate for the seat of Weston-Super-Mare in the general election, lost out to Mr Bramall in the contest to represent Whitchurch Park ward at this year’s local elections.

His hate campaign began shortly afterwards.

Bradley pleaded guilty to harassment at Bristol magistratres’ court and will be sentenced at a later date.

His solicitor Anna Van Wely said he had been suffering a “difficult period” in his life. She said he was now receiving counselling and had cut down his drinking.

“I think it is probably the case that this man has been suffering from a mental health problem for some time,” she said.

Mr Bramall said the messages were “unpleasant” but he was not frightened by them.

“[Bradley] clearly has some mental health issues,” he said. “I don’t really hold any malice towards him. I just think it’s sad that he has done it and got himself in this situation.”

A South West Labour spokesperson said Bradley had been suspended by the Labour Party.

Mother of gay suicide teen pleads for anti-bullying action

The mother of a California teenager who killed himself after he was bullied for being gay has pleaded with his school district to do more about the problem.

Seth Walsh, 13, died nine days after hanging himself in September. He had endured years of homophobic bullying at school.

His mother Wendy and the American Civil Liberties Union (ACLU) have asked Tehachapi school district to prevent another tragedy.

In a letter sent yesterday, they asked the school district to work with them and demanded that changes be made.

Mrs Walsh has also recorded a video (see below) about her son.

She said that teachers did not seem to care that her son was badly bullied and had done nothing to stop the harassment.

She said: “Seth told me he was gay when he was in the sixth grade. He was a wonderful, loving child, and I loved him for who he was.

“I can’t bring my son back. But schools can make a difference today to keep this from happening to any more young people. Schools need to take harassment and bullying seriously when parents or students tell them about it, and when they see it in the halls.”

According to Seth’s mother and close friends, some teachers even joined in the bullying. One allegedly called him “fruity” in front of a class of students.

Mrs Walsh said her son was a clever student but his grades had fallen as the harassment intensified. She said teachers were aware he was suffering but did not respond to her pleas for something to be done.

His friends said he had become depressed and frightened about using the bathroom or boys’ changing room before gym class.

He was taunted with abuse such as “fag” and “queer”, they said.

Seth hanged himself from a tree in the family garden on September 17th. He left a note criticising his school for not helping him and died in hospital on September 28th.

An investigation carried out by the ACLU said that school district officials were aware of the bullying but “largely ignored” it.

California law requires schools to protect students from harassment based on sexual orientation and the US Department of Education has also launched an investigation of the school district.

The ACLU says that at least 11 LGBT teenagers have killed themselves after suffering bullying in the last few months.

“Students have the right to be safe and supported at school for being exactly who they are. And parents deserve to know that their kids are going to school in a respectful environment where they are nurtured to reach their full potential,” said Elizabeth Gill, staff attorney with the ACLU LGBT Project and the ACLU of Northern California.

“Public schools have a duty to protect students from harassment based on sexual orientation, but too many schools get a failing grade in this respect.”

Gay referee Nigel Owens on reporting homophobic abuse

Rugby referee Nigel Owens has spoken about why he called police over homophobic abuse at a recent game.

He was on duty at a Welsh premiership game between Llanelli and Neath at Parc y Scarlets last month when a fan allegedly began shouting anti-gay abuse.

Mr Owens told the South Wales Post: “It’s the first time it’s happened when I have heard it so loud, the stadium was fairly empty and everyone there must have heard it, I know the players did.

“The reason something needs to be done about it, and why I took it to the police, however, is I recently spent six hours talking to a young rugby player who was contemplating taking his own life because he felt that he couldn’t deal with coming out.

“I have been through it myself and was telling him people would understand.

Then a few days later you get an idiot like that shouting homophobic abuse. It’s really not on.

“The Samaritans will tell you that around 4,000 young men a year take their own life in the UK and the reason in some cases is because they can not adjust to being gay.”

The referee, 39, is supporting a Samaritans campaign to prevent male suicides. He has documented his own struggle with depression and admitted he tried to kill himself at the age of 26.

Llanelli police are appealing for witnesses to the alleged abuse, which happened just before half-time at the November 15th game.

Pair convicted of homophobic killing

A 20-year-old man and an 18-year-old woman were convicted today of the manslaughter of gay man Ian Baynham.

Ruby Thomas and Joel Alexander, both of south-east London, are facing jail.

Mr Baynham, 62, died 18 days after he was attacked in Trafalgar Square in September 2009.

The Old Bailey heard this month that he had suffered homophobic abuse before being knocked to the ground and then kicked and stamped on.

The assault was described as a “Clockwork Orange-style” attack.

Mr Baynham suffered severe head injuries and never regained consciousness.

Alexander and Thomas were found guilty of manslaughter and affray in a retrial. The jury in the previous trial could not agree on a verdict.

Rachel Burke, who was also present at the attack, was cleared of assault but found guilty of affray at an earlier hearing.

Prosecutor Brian Altman QC told the court that Ms Thomas had drunkenly hurled anti-gay abuse at the pair and Mr Baynham had confronted her.

Ms Thomas is said to have lashed out at Mr Baynham and he retaliated towards her friend, Rachel Burke, the jury heard.

The court was told that Mr Alexander then knocked Mr Baynham to the floor with a punch to the jaw.

As he lay on the floor, the girls are said to have kicked him and stamped on him.

Mr Alexander admitted punching the older man but said he struck out to protect the girls.

Mr Baynham died from head injuries sustained when he hit his head on the pavement, the court heard.

Thomas, a former private school pupil, already has a conviction for violence after assaulting a bus driver in 2007.

Thomas, Burke and Alexander will be sentenced in the New Year.

The House of Representatives has for the second time passed a bill to overturn the US’s military’s ‘Don’t Ask, Don’t Tell’ policy that bans military personnel from being openly gay.

The vote, which was was 250 to 175, pressurises the Senate to delay its recess for Christmas in order to vote to repeal or keep the law. In January, those senators and congressmen elected in the mid-term elections held last month, will be sworn into office, with more Republicans in office, diminishing hopes of finally ending the ban.

“It’s been a long time coming, but now is the time for us to act,” Speaker Nancy Pelosi (Democrats) said prior to the vote. “We know our first responsibility as elected officials. We take an oath of office to protect and defend, and our first responsibility is to protect the American people, to keep them safe. We should honor the service of all who want to contribute to that security.”

Yesterday, the head of the marines said that repealing the law would lead to the death of troops troops. “When your life hangs on a line, on the intuitive behaviour of the young man … who sits to your right and your left, you don’t want anything distracting you,” said Marine Commandant General James Amos.

“I don’t want to lose any Marines to distraction. I don’t want to have any Marines that I’m visiting at Bethesda [hospital] with no legs,” he added.

“When your life hangs on the line, you don’t want anything distracting. . . . Mistakes and inattention or distractions cost Marines’ lives. That’s the currency of this fight.”

But senior military officials including the Defense Secretary Robert Gates support the repeal of ‘Don’t Ask, Don’t Tell’.

In May, the House of Representatives voted 234-194, in favour of repealing the ban. This was followed by the Senate Armed Services Committee who followed the same path and voted 16-12 in favour of axing the law. In both cases, the measure was offered as an amendment to a defence spending bill

But, the hopes to repeal the law have been continually blocked in the Senate, mainly on procedural grounds. Just last week, a bill failed to get the 60 votes needed for a debate to be initiated.

A new bill, focused purely on the repeal of ‘Don’t Ask, Don’t Tell’ has been introduced by Senator Susan Collins and former Vice-Presidential candidate Senator Joe Lieberman. The vote in the House of Representatives, puts enormous pressure on the Senate to debate the issue this weekend, before the recess.

Baynham killing ‘shows homophobia must be tackled in schools’

The killing of out gay man Ian Baynham shows that work to tackle anti-gay bullying in schools must continue, campaigners have said.

Mr Baynham’s killers, Ruby Thomas and Joel Alexander, were teenagers at the time of the homophobic attack last year.

Today, they were found guilty of his manslaughter. Rachel Burke was found guilty of affray at an earlier hearing.

The Old Bailey heard that Thomas had shouted homophobic abuse at Mr Baynham and “put the boot” into him as he lay dying on the floor.

Gay rights groups said that his killers’ ages proved that plenty of work still needs to be done in schools.

Ben Summerskill, Stonewall chief executive, said: “We welcome this verdict and urge the judge to take into consideration the homophobic element of this crime when sentencing.

“The perpetrators of this homophobic crime were educated in Britain’s education system within the last five years – demonstrating how much more needs to be done to tackle homophobia in our schools before it festers into violence on the streets.”

Paul Martin, of the Lesbian and Gay Foundation, added: “This is a hugely important result, but it is still greatly upsetting that we live in a society where these crimes are still happening and that Ian Baynham is no longer with us.

“The three accused of attacking Mr Baynham were still teenagers at the time of the attack, not long out of the UK education system, highlighting the work that needs to be done in all schools, other young peoples’ settings and throughout society to change attitudes, promote understanding and challenge homophobia.”

He added: “But today’s ruling sends out an important message, that prejudice won’t be tolerated, that homophobic hate crimes are treated seriously and that lesbian, gay, bisexual and trans people should have the confidence to report hate crimes.

“Our thoughts are with Ian’s family and friends.”

"I don't want to lose any Marines to distraction. I don't want to have any Marines that I'm visiting at Bethesda (hospital) with no legs," he said. His comments were the toughest yet on the issue, after he testified at a congressional hearing that he opposed lifting the ban in a time of war. Metro Weekly's Chris Geidner reports that Amos' comments have sparked outrage among pro-repeal groups. Amos is cherry-picking the data to support his 20th century views, and everyone knows it." Belkin added, "Gen. Army Birther Convicted On All Counts

Lt. Colonel Terrence Lakin, the Army birther who said he didn't have to obey the orders of his "illegitimate" commander in chief, has been found guilty on four felony counts of military disobedience at his court-martial.

"I am extremely sorry for everything that has come of this," Lakin said during unsworn testimony in the sentencing phase of his trial. "As a military member, I was wrong." Lakin faces as much as 42 months in prison, forfeiture of pay and retirement benefits, and dismissal from the service after being convicted of four felonies. The court-martial panel found him guilty of two counts of disobeying orders to report to his commanding officer, one count of failing to report to his new unit, and, most seriously, missing the movement of an airplane that was to take him to his new post. Lakin will be sentenced tomorrow.

Lakin says he continues to believe the president is not a U.S. citizen, but that he shouldn't have allowed that opinion to affect the orders of his immediate superiors.

Kevin Spacey: ‘Asking me about being gay is like bullying’

Kevin Spacey has compared media interest in his sexuality to anti-gay bullying.

The actor has fiercely protected his private life and has denied that he is gay for years.

Speaking to interviewer Kevin Sessums for the Daily Beast website, Spacey equated the interest in his personal life to the bullying suffered by gay teenagers who attempt suicide.

Sessums said: “We gay men have always proudly claimed you as a member of our tribe, and yet you don’t proudly claim us back. Why?”

In response, Spacey said: “Look, I might have lived in England for the last several years but I’m still an American citizen and I have not given up my right to privacy.”

After Sessums argued that heterosexuality was not considered private, the actor continued: “I think what we have seen in terms of gay teenagers committing suicide because of bullying is anguishing. I think young people, if they are feeling like they are confused, need to know that there are people to talk to and that there are places they can go and not feel alone.

“But I feel that they have just as many rights as I do to not be bullied. And I don’t understand people who say, ‘Well, this is a terrible thing that is happening to this young person whose life is being exposed,’ and then turn around and do it to another person.

“People have different reasons for the way they live their lives. You cannot put everyone’s reasons in the same box. It’s just a line I’ve never crossed and never will.”

Sessums responded that he did not consider the line of questioning to be bullying and asked whether the actor would make an ‘It Gets Better’ video.

Spacey said: “Yeah. Absolutely. I’d do one of those. But why is it in this country that kids might think it’s okay to bully and make fun of somebody?

“I’ll tell you why, because what do they see in the media happening all the time? In the media they seem to think that’s okay. So if we stop using sexuality as a weapon against people maybe everyone will eventually get cool with it.”
